Flycom Technologies d.o.o. is committed to protecting your personal data. Our privacy policy and protection of your personal data is based on Regulation (EU) 2018/1725 and the Personal Data Protection Act (ZVOP-2). The purpose of this Privacy Policy is to help you (the individuals whose data we process) understand what personal data we collect, why we collect it and how we use it.

1. WHO PROCESSES YOUR PERSONAL DATA?

The controller of your personal data is Flycom Technologies d.o.o. (hereinafter referred to as “Flycom”), which maintains a description of personal data collections in accordance with the provisions of ZVOP-2. At Flycom, we understand the importance of privacy, and accordingly, all Flycom employees work hard to keep your personal data safe with us. Employees who process personal data are familiar with the catalogue of personal data collections and access to the catalogue of personal data collections is available to anyone who requests it. To this end, we have established rules and procedures and put in place technical and organisational measures to ensure an adequate level of security in the processing, use and access to your personal data.

Flycom maintains an up-to-date list clearly indicating for each personal data collection which person is responsible for each personal data collection and which persons may, by the nature of their work, process personal data relating to each personal data collection. The following information shall be entered in the list: the name of the personal data collection, the personal name and function of the person responsible for the personal data collection and the personal name and function of the persons who, by the nature of their work, may process personal data relating to the personal data collection.

A written contract shall be concluded with any external legal or natural person who carries out specific tasks relating to the collection, processing, storage or transfer of personal data and is registered to carry out such activities (the contract processor). Such contract shall also lay down the conditions and measures to ensure the protection and safeguarding of personal data. Outside legal or natural persons may only provide personal data processing services within the scope of the client’s mandate and may not process or otherwise use the data for any other purpose.

2. WHAT PERSONAL DATA DO WE PROCESS ABOUT YOU AND WHY?

Processing of personal data means any operation which is performed in relation to personal data, in particular collection, retrieval, recording, adaptation, storage, access, use, transmission, dissemination, classification, erasure or destruction. Processing may be manual or automated. The type, basis and manner of processing of your personal data depends in particular on the purpose for which your data is processed.

2.1 PROCESSING OF PERSONAL DATA BASED ON YOUR CONSENT

Consent means any voluntary, specific, informed and unambiguous indication of your wishes by which you express your agreement to the processing of personal data for a particular purpose. You may give your personal consent by a declaration or other clear affirmative action. In the case of the use of the www.flycom.si website, consent is deemed to be given when you confirm on the website by clicking on the box that you allow the processing of personal data for a specific purpose. If you are under 15 years of age, consent is only valid if it is given or authorised by one of the child’s parents, his/her guardian or a person to whom parental care has been granted.

2.2 PROCESSING OF PERSONAL DATA THROUGH THE WEBSITE

Flycom collects information about your use of the flycom.si website, which relates to both the manner and purpose of use. This information is important to us because it enables us to ensure that we are able to provide the expected level of quality from flycom.si, while complying with our legal obligations and in line with our desire to continuously improve the service we provide to you.

The flycom.si website uses cookies. Details about cookies, how they are used, stored and prevented can be found on the flycom.si website under “Privacy Policy and Cookies”.

Flycom may also collect information about your geographic location, which we may access based on your IP address or GPS data in your electronic devices, while you are browsing our website. This information is also used for the purpose of improving the quality of our services. Users are free to turn off or restrict access to geo-location data within their electronic device.

In some cases, Flycom also collects your data using other online tools and sources, which may be combined with other data you give us access to.One such data source is Facebook Pixel, which allows us to track your activity on the website and transmits this data to the Meta online platform. This enables us to offer you content and information via Facebook and Instagram that is tailored to your preferences and interests based on your search results on our website. In this way, we enable you to use products and information about products that you might not normally find out about, with the main interest being to ensure the highest quality. Such tools may be embedded in the website, video content and emails and may allow us to retrieve certain information from your electronic device, such as when you viewed a particular sub-page.

2.3 PROCESSING OF PERSONAL DATA FOR MARKETING PURPOSES

If you have entered into a contract with us or have any other business interaction with us that falls within the scope of our legitimate business, we may also use some of your personal data (name and surname, address, telephone number, email address) for direct marketing purposes on the basis of the law (the law governing the protection of personal data and the law governing electronic communications) or our legitimate interest, if you have consented to this. If you have consented to this, any personal data that Flycom processes about you in its databases may also be used for direct marketing purposes, i.e.:

  • for sending offers, advertising material, magazines and invitations to events,
  • for the survey,
  • to create tailored offers for you, based on assessing and anticipating your interests, economic situation, needs (profiling), etc.
  • Direct marketing can be done through all communication channels: regular mail, email, text messages, phone calls and social networks.

3. WHEN AND HOW CAN YOU REQUEST THAT WE STOP USING YOUR PERSONAL DATA?

If we process your personal data on the basis of your consent (e.g. processing for direct marketing purposes), you may at any time request in person or in writing to our address (Celovška cesta 520, 1210 Ljubljana – Šentvid) or by e-mail(info@flycom.si) that we permanently or temporarily, partially or completely stop using your personal data for these purposes. Your withdrawal does not affect the lawfulness of the processing carried out on the basis of your consent until the withdrawal.

4. WHAT RIGHTS DO YOU STILL HAVE AND HOW CAN YOU EXERCISE THEM?

If Flycom processes your personal data, you have the following rights:

  • you can request access to and copy your personal data;
  • You may request that your personal data be completed or corrected if it is incomplete or inaccurate;
  • you may request the erasure of your personal data, in particular if they are no longer necessary for the purposes for which they were collected, if they have been unlawfully processed, if they have been processed on the basis of your consent, or if you have withdrawn your consent and there is no other legal basis for their processing;
  • you may request restrictions on the processing of your personal data, in particular if you contest their accuracy – for a period that allows us to verify the accuracy of your personal data;
  • you may request the transfer and receipt of personal data processed by automated means and the processing of which is based on your consent or on a contract, in a structured, commonly usable and machine-readable format;
  • you may object to the processing of your personal data at any time on grounds relating to your particular situation, where processing is necessary for the performance of a task carried out in the public interest or for legitimate interests.

In this case, we will stop processing your personal data unless our compelling legitimate interests for processing outweigh your interests, rights and freedoms.

You may exercise the rights set out above by sending your request by post to Flycom Technologies d.o.o. (Celovška cesta 520, 1210 Ljubljana – Šentvid) or by e-mail (info@flycom.si). The request must contain sufficient personal data to identify you, specify the form in which you wish to receive a reply and clearly identify the request. We will respond to your request without undue delay, but no later than within one month. This time limit may exceptionally be extended by two months, of which we will inform you in advance.

If you do not receive a timely response to your request, or if your request is, in your opinion, unjustifiably denied, you may lodge a complaint with the Information Commissioner of the Republic of Slovenia, Dunajska cesta 22, 1000 Ljubljana, telephone: 01/230-97-30, email: gp.ip@ip-rs.si.

5. HOW DO WE PROTECT YOUR PERSONAL DATA?

Flycom processes your personal data in accordance with the requirements of the data protection regulations. Flycom uses organisational, technical and other appropriate procedures and measures to protect personal data and to prevent unauthorised destruction, alteration or loss of data and unauthorised processing. The procedures and measures are described in detail in Flycom’s internal Personal Data Protection Policy and Information Security Documents.

6. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

Personal data collected for the purpose of concluding contracts is kept until the purpose for which it was collected has been fulfilled. Personal data processed solely on the basis of your consent will be kept until your consent is withdrawn. After the expiry of the retention period, the personal data shall be erased, destroyed, blocked or anonymised, unless otherwise provided by law or another act.

We reserve the right to make changes. Any changes to this policy will be publicly posted on this page. In the event of major changes, we will post a more prominent notice.
